Personal reputation and company reputation

Personal or company reputation can be damaged or slandered, and this is has been defined by italian law:

“The tort of interference with the right to personal identity occurs when there is distortion of the actual identity or alteration, blur, challenging the intellectual, political, social, religious, ideological, professional property; the existence of the crime of diffamation occurs when such damages are achieved through the offence of reputation” (Court of Cassation, pen. 06.12.1992, 849).

The breadth of the damages to personal identity is proportional to the diffusion of the damaging contents and to the fact that these get in touch with a great number of people, since reputation is defined as the image an individual gives to community.

Increasing damaging contents

In the Internet channel, the risk of damaging content spread is higher than in traditional media because contents themselves can be posted over and over again during time, exposing the subject involved to permanent reputation damages.

At the moment there is no specific law for internet slander, so it is now prosecuted as a severe press slander (comma 3).

In the internet slander the most difficult thing is identifying the physical place in which the offence has been committed: since it can’t be considered the place of perception of the defamatory content, which changes according to user position, it is instead identified with the place of content release, that could well be even in a foreign country.

How can we cope? In a recent decree (Cass. Pen. Section V sent. 4741/00) on a competence conflict, Court of Cassation has determined that to identify the Competent Judge “it will be necessary to consider the address of the online newspaper in which the defamatory article appeared” (from IlTuolegale.it).

This position takes into consideration the quality perception of the slander, which doesn’t take place at the moment of the diffusion of the message, but at its reception by readers (affecting their opinion on the “victim”); on the other hand though it seems not to consider the spread power of the content in the net. A defamatory news can be brought to other online channels with an even bigger audience than the originary, so to produce a sort of damage reiteration, able to persist even after the reconnaissance of the first author.

In legal assistance procedures in reputation slander and damage it is becoming more and more important to rely on digital technologies support and analysis methods able to prevent potentially damaging contents (such as brands or companies willing to fight quickly against these cases) or able to create a map of all contests presenting the damaging content, estimating a risk index of further propagation.
